Apple has offered today a refund to Australian buyers who consider they were misled about the 4G capabilities of the new iPad.
This was after Australia's Competition and Consumer Commission stated yesterday that "Apple's recent promotion of the new 'iPad with Wi-Fi + 4G' is misleading because it represents to Australian consumers that the product can, with a SIM card, connect to a 4G mobile data network in Australia, when this is not the case."
Australia's existing 4G network, provided by the company Telstra, works on a frequency not compatible with the new iPad.
At a preliminary hearing, besides offering to refund customers, Apple lawyer Paul Anastassiou told the court that "other networks operated by Telstra are in fact properly described by international standards as 4G, even though Telstra itself does not so describe them."
As stated by the lawyer, the defense that Apple will use when the matter comes to full trial will be that the new iPad works on other Telstra frequencies that can be considered as 4G, even though they are not presented as such by Telstra.
